Director of Gurugram-Based Real Estate Firm Arrested For Disobeying Refund Order

Gurugram, March 17, 2025: Director of Gurugram-based Ninaniya Estates Limited Prateek Rao has been arrested following the issuance of arrest warrants on March 9, 2025 against him and Rahul Kumar Pathak, another director of the firm, by the Gurugram office of the Haryana Real Estate Regulatory Authority (RERA).

The arrest came on a petition seeking execution of a RERA order of November 15, 2023. This order had directed Ninaniya Estates Limited to refund the entire amount of INR 26.07 lakh it had received from complainant Sohan Lal, along with interest at rate of 10.75 per cent per annum from the date of each payment till actual refund after adjusting amount or assured return paid by the firm.

Since no amount was paid, the complainant filed a petition to execute the RERA decree. On the complainant’s application for the Joint Development (JD) to disclose its assets, suitable direction was issued by RERA on May 28, 2024. The JD was given till September 3, 2024 to comply.

The JD did not file the directed affidavit and arrest warrants were then issued against its directors. The bailiff who was to execute the warrants sought police assistance and it was provided.

Now under arrest, Rao has admitted to being a director of the JD but days he was unaware of the case despite being served notice.

As per Order XXI Rule 41(3) for this kind of disobedience, the civil detention can extend up to three months. Rao has been committed to civil prison at Bhondsi Jail for a month. He is to be produced before RERA on April 16.
