Under the provisions of Rule-24, allottee gets possession of the unit by the Adjudicating Officer of RERA

Lucknow/Gautam Buddh Nagar, June 19, 2024: The Adjudicating Officer of U.P. RERA, RP Singh, while virtual hearing the complaint of an allottee under the provisions of Rule-24, ensured that he got possession of his unit. The adjudicating officer had issued an order to the promoter to resolve the dispute before the bench by appearing physically due to repeated violation of the authority’s order. Following this order, the promoter’s representative handed over the keys of his unit to the allottee before the Adjudicating Officer and assured to submit the no objection certificate regarding liability and a copy of the possession certificate to the bench soon. Pleased with the efforts of the Adjudicating Officer of U.P. RERA, the allottee expressed satisfaction on getting the keys of his unit and appreciated the efforts of RERA.
Allottee Meraj Ansari had booked a unit in M/s Uttam Steels and Associates (Consortium) in the year 2010 but after delay in getting possession, he filed a complaint against the promoter in U.P. RERA in the year 2019. While hearing the case, the bench had ordered to give possession to the allottee which was not complied with by the promoter. To ensure compliance of the orders of getting possession from the promoter by the allottee, such cases are being transferred to the Adjudicating Officer of the Authority under the provisions in Rule-24 of U.P. RERA Rules, 2018. Under Rule-24, the order passed by the bench in such cases is being implemented in the same manner as if the order in question is a decree of the Principal Civil Court in which the Adjudicating Officer can attach the unit to ensure the possession given to the allottee as well as get the registry done in his favour.
Adjudicating Officer R.P. Singh said, “The allottee’s tower had been constructed by the promoter and it was ready for the possession but possession was not being given. This is a violation of the provisions of the RERA Act. For this reason, the promoter was summoned before the bench and the allottee was given the keys of his unit there.”
