Uttar Pradesh RERA to file impleadment application in NCLT in Matter of Ansal A.P.I.


Lucknow/Gautambudha Nagar, March 10, 2025: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has decided to file an impleadment application before the NCLAT and challenge NCLT order of 25th February, 2025 in the matter of Ansal API Ltd. Thousands of allottees have made investment of their life savings in the townships of Ansal API at Lucknow and Gautambudha Nagar and have been waiting for the delivery of their houses for years. Quite a large number of the aggrieved allottees of Ansal API have file complaints with RERA for delivery of their houses or return of their investments.
UP RERA has already decided 2,825 such complaints and it was with those efforts that an amount of INR 125.39 crore, payable to the allottees, could be recovered from the Ansal API. A large number of allottees are still waiting for possession of their houses or plots. All pending recovery certificates sent to the I.R.P. Ansal had still not complied with 1234 orders of RERA, 619 recovery certificates are pending for recovery comprising INR 113 crore due to the allottees and another INR 19.73 crore against 27 recovery certificates of penalty imposed against the promoter for non-compliance of the orders of RERA and violation of the RERA Act.
UP RERA had imposed a penalty of INR 14.40 crore against Ansal API in six matters in the month of January when the promoter was found indulging in unlawful registration of sale deeds of plots without registering the land parcel in question with RERA. Recovery certificates had been sent for recovery to District Magistrate Lucknow in all these matters.
UP RERA has sent all the recovery certificates issued against the promoter, in lieu of amounts payable to the allottees, to I.R.P. Shri Navneet Kumar Gupta for the payment of the same on priority. RERA has also sent to the IRP the details of 219 orders pending under execution proceedings, for facilitating delivery of houses or plots of such allottees on priority.


UP RERA Chairman Sanjay Bhoosreddy says that Ansal API had been evading its responsibilities to complete its projects and UPRERA has resolved to file an impleadment application in the NCLAT to not let the Ansal run away from its responsibilities and to guard the interest of the homebuyers. The chairman also said that it is the first time since the commencement of the IBC that RERA has decided to file an impleadment application in the NCLAT, seeing the vast interest of the allottees at stake. RERA is also pressing upon the I.R.P. to facilitate the payments against the RERA RCs on priority.
