UP RERA Ensures Delayed Possession Payment Possession To Allottee

UP RERA conciliation forum ensured interest of the delay period in the possession of the unit and merged it in the final demand of the promoter before possession. Post mediation of the conciliation forum, Gaur Sons Hi-Tech Infrastructure Pvt. Ltd. and the allottee, Ms. Neetu Thakur, the promoter waived off maximum charges of the final demand which was Rs. 1.40 lakh. The allotte got Rs. 35,000 as delay interest which was further merged in the last demand and finally possession of the unit was ensured to the allottee.

According to the allottee, she had booked a unit in 2015 in the project. The cost of the unit was Rs. 10.52 lakh and following the Agreement for Sale, she had paid almost full amount. The possession was proposed in August 2018 but she did not get possession. Due to delay in possession, charges in various heads in the last demand and no interest of the delay period from promoter, she filed an official complaint (GAU20920209260) in UP RERA.

Post mediation of the conciliation forum, the promoter agreed to waive off charges of various heads and offered possession as per actual due which was accepted by the allottee. Both parties agreed and signed an agreement and submitted a copy to the Regulatory Authority. 

Due to efforts of the Conciliation Forum of Regional Office, U.P. RERA, almost 1300 matters have been resolved and properties worth Rs. 510 Cr. have been settled.
