UP RERA Ensures Possession of Unit With Interest For The Delayed Period

U.P. RERA Conciliation forum ensured possession of 1 unit with interest of the delay period to the allotee, Rajeev Aggarwal, in the Devaika Gold Homz project, developed by Devaika Gold Homz P. Ltd. in Gr. Noida, Gautam Buddh Nagar. Post mediation, the demands of both parties have been merged and as per the new agreement between the promoter and the allottee, the allottee will pay Rs. 2.50 lakh to promoter and get handover the unit will all amenities in the Agreement for Sale. Also, advance maintenance charges will be applicable from the actual date of possession.

According to the allottee, he had booked a units in the project. The cost of the units was Rs. 16.76 lakh and following the Agreement for Sale, he had paid Rs. 16.49 lakh. But he did not get possession and promoter did not respond on delay period. Witnessing very slow pace of development, verification of charges in last demand letter, Rs. 8 lakh, and interest of the delay period, he filed an official complaints (GAU212202114040) in U.P. RERA.

Post mediation of the conciliation forum, the demands of both parties were merged and promoter agreed to charge advance maintenance charges from actual date of possession. This proposal was accepted by the allottee and the dispute was resolved on mutual settlement. Satisfied with the settlement, the allottee appreciated the efforts of U.P. RERA.

U.P. RERA Chairman Sanjay Bhoosreddy said, “Promoter and allottes can choose Conciliation Forum for mutual settlement of the matters. The Conciliation forum offers mediation of the Conciliator along with association of allottees and promoter for settlement who put all effort to settle the dispute mutually.” 

Due to efforts of the Conciliation Forum of Regional Office, U.P. RERA, more than 1300 matters have been resolved and disputes related to properties worth Rs. 510 Cr. have been settled.
