UP RERA simplifies filing, scrutiny and hearing process of complaints

Lucknow/Gautambuddh Nagar, Jan 12, 2023: UP RERA has e-courts system for filing of complaints by the home buyers and the promoters. It has issued revised SOP on December 2, 2023 for filing, scrutiny and hearing of complaints and conciliation. In doing so, U.P. RERA has not only simplified the process of filing of complaints, but has made it more comprehensive also. Now the process is more user-friendly and will be conducive to early listing and speedy disposal of complaints, says a press release issued by the Authority.  

As per the revised SOP, any allottee intending to file a complaint with RERA, shall have to first create his profile under the complaint section of its web portal www.up-rera.in where he shall give all relevant particulars including his e-mail address and mobile number. 

If an allottee or promoter is filing the complaint with the help of an authorized nominee or a professional, such as an advocate or company secretary, their e-mail I.D. and the mobile number need to be given.

UP RERA has created dashboard of all complainants with facility for filing complaints with the RERA or the Adjudicating Officer or the Conciliation forum, as the case may be. Since RERA promotes amicable settlement of disputes between the allottees and the promoters, the complainant is first given an option for conciliation and if he does not opt for conciliation, he is required to answer the questions relating to the pending or decided complaints in the same matter either in the RERA or the consumer forum or any existing order of NCLT with respect to the concerned promoter company. Further options and suggestions for filing of complaints are available in the light of the information given by the complainant.

The complainant has preview and editing options after filling the complaint form before depositing the requisite fee of Rs. 1000/- and submitting the complaint. The complainant is required to upload the authorization letter of the authorized person or the vakalatnama of the advocate, as the case may be.

The complainant must enclose the legible copies of the documents, such as the allotment letter, the agreement for sale (BBA), the copies of the payment receipts etc in PDF form. These arrangements are intended to facilitate early listing and disposal of complaints.

The complainant shall get the complaint I.D. of his complaint as soon as he submits the same after duly depositing the requisite fee. The complainant must download the complaint and attached documents and submit a self attested hard copy of the same in the office of U.P. RERA at Lucknow or NCR, as the case may be.

This SOP is available on the web portal of the U.P. RERA.It was stated by Sanjay Bhoosreddy, the Chairman U.P. RERA that the Authority is continuously improving its processes keeping in view the convenience of the allottees and other stake holders and that the revised S.O.P. for filing of complaints is an important initiative in this direction.
