UP RERA issues Standard Directions for Advertisements of Projects
Lucknow/Gautam Buddh Nagar: After a Government Order by UP Government related to advertisements of real estate projects, UP RERA has instructed all stakeholders to follow mentioned standard directions for all kinds of promotion and advertisements. Mentioning RERA Registration Numbers and UP RERA Portal is a mandatory provision in advertisements of projects on the platforms like newspapers, magazines, brochure, leaflets, electronic, outdoor, social and digital media.
RERA Registration Numbers and U.P. RERA Portal should be quickly and easily readable in Print advertisements (newspapers, brochure, leaflets, pamphlets, etc.), Social media (Twitter, Facebook, Instagram, Youtube, etc.) and Digital media (email, web portal, property sites). In Electronic media and Radio Channels, both should be announced at a standard pace for listeners and viewers to understand. For Outdoor hoardings, pole, and street banners, RERA Number and portal should be written in highlighted, bold and higher fonts in order to visualize and read clearly.
A press release issued by UP RERa says that, while observing advertisements and promotions of real estate projects on online and offline medium, it has been noted that promoters, real estate agents, public relations agencies and institutions releasing ads of projects are not following provisions of the RERA Act. In multiple advertisements, UP RERA Registration Numbers and RERA Portal were mentioned in Disclaimer and fonts were small enough to miss easily. In some advertisements, both were mentioned prominently and almost outside from the advertisement portion. U.P. RERA is creating awareness among all the stakeholders about norms of advertisements, issuing notices to the violators and penalizing them also.
As per the objectives of the RERA Act 2016, authentication of real estate projects, being promoted and advertised for the purpose of sale or lease, is one of the core and fundamental provisions. In the section- 3, 7, 10, 11, 12, 59, 60, and 65 of the RERA Act all provisions related to marketing, promotion, sales and advertisements have been mentioned that should be considered.
According to Sanjay Bhoosreddy, Chairman- UP RERA, “RERA Registration Numbers and UP RERA Portal should be mentioned clearly in bold and big fonts in the advertisements and that too at a prominent place. This is a joint responsibility of promoter, agent and media institutions. Non compliance of this will result in action against promoters and agents. For media houses, violations will be forwarded to the Ministry of Information and Broadcast, GOI for suitable action.”
